Holster Safety Disclaimer and Limitation of Liability

IMPORTANT: PLEASE READ BEFORE PURCHASE OR USE

By purchasing or using any holster or product from [Defcon 1 Gear/Defcon 1 Group], you (the "Customer") agree to the following terms and conditions regarding safety, liability, and proper usage.

1. Assumption of Risk

The use of firearms is inherently dangerous. Serious injury or even death may result from the improper handling or use of firearms and related equipment. By purchasing this Product, you represent that you are of legal age and possess the necessary training and knowledge to handle a firearm safely. You assume all risk of injury or death associated with the use of our Products.

2. Holster Fitment & Compatibility

Each holster we produce is handcrafted for specific firearm models.

  • No Modifications: Never attempt to modify, heat, or alter your holster.

  • Check Fitment: Upon receipt, and with an unloaded firearm, ensure the holster fits your specific handgun perfectly. If the fit is too loose or the trigger guard is not fully protected, do not use the holster.

  • Aftermarket Parts: Our holsters are designed for factory-standard firearms. The use of aftermarket triggers, lights, lasers, or extended slide releases may make the holster unsafe.

3. Proper Use & Maintenance

  • Trigger Protection: It is the user’s responsibility to ensure that no clothing, drawstrings, or foreign objects enter the trigger guard during holstering.

  • Wear and Tear: Handcrafted materials  (Kydex) can wear over time. Regularly inspect your holster for cracks, softening, or loose hardware. Discontinue use immediately if the holster loses its structural integrity.

  • Training: We strongly recommend professional firearms training. "Negligent discharges" are almost always the result of improper technique or ignorance of safety protocols.

4. Limitation of Liability & Hold Harmless

To the maximum extent permitted by law, [Defcon 1 Gear/Defcon 1 Group], its owners, and employees shall not be liable for any direct, indirect, punitive, or incidental damages to person or property arising out of:

  1. Misuse or Abuse: Use of the Product for anything other than its intended purpose.

  2. Ignorance: Failure to follow standard firearm safety rules or specific Product instructions.

  3. Modifications: Any alteration made to the holster or the firearm it holds.

  4. Negligence: Improper holstering techniques or lack of maintenance.

BY PROCEEDING WITH THIS PURCHASE, YOU AGREE TO HOLD [Defcon 1 Gear/Defcon 1 Group] HARMLESS FROM ANY AND ALL CLAIMS, ACTIONS, OR LIABILITY ARISING FROM THE USE OR MISUSE OF OUR PRODUCTS.
